Please read these terms and conditions carefully before using our services

1. Acceptance of Terms

By accessing and using Makini Defensive Driving School's services, website, facilities, or enrolling in any of our courses, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service and our Privacy Policy.

Important: These terms constitute a legally binding agreement between you and Makini Defensive Driving School. If you do not agree with any part of these terms, you must not use our services or enroll in our courses.

These terms apply to all students, visitors, and users of our services, regardless of how you access or use them.

2. Enrollment and Payment

2.1 Enrollment Process

To enroll in any of our courses, you must:

  • Complete the official enrollment form with accurate information
  • Provide all required documentation (ID, photos, medical certificate)
  • Meet the minimum age requirement for your chosen course
  • Pay the required course fees in full or as agreed in a payment plan

2.2 Payment Methods

We accept the following payment methods:

  • Cash payments at our offices
  • M-Pesa transfers
  • Bank transfers to our official accounts
  • Mobile banking

Note: Course fees are subject to change without prior notice. However, once you have paid and enrolled, your course fee is locked in for the duration of your training.

2.3 Payment Plans

We offer flexible payment plans for students who cannot pay the full course fee upfront. The following conditions apply:

  • A minimum deposit of 50% is required to secure your enrollment
  • The remaining balance must be paid before the final practical test
  • Failure to complete payments may result in suspension of training

3. Cancellation and Refund Policy

3.1 Student-Initiated Cancellations

If you need to cancel your enrollment, the following refund policy applies:

3.2 School-Initiated Cancellations

In rare cases, we may need to cancel a course due to unforeseen circumstances. In such cases:

  • You will receive a full refund of all fees paid
  • We will offer you the option to transfer to another course at no additional cost
  • We will provide at least 7 days' notice whenever possible

Important: Refunds will be processed within 14 business days from the date of cancellation approval. The refund will be issued using the same method as the original payment.

4. Attendance and Conduct

4.1 Attendance Requirements

Regular attendance is mandatory for all students. The following requirements apply:

  • Students must attend at least 80% of all scheduled classes
  • Repeated absences may result in suspension or termination of enrollment
  • Make-up sessions may be available at an additional cost
  • Students arriving more than 15 minutes late may not be allowed to join the session

4.2 Student Conduct

We maintain a professional learning environment. All students are expected to:

  • Treat instructors, staff, and fellow students with respect
  • Follow all instructions from instructors immediately and without argument
  • Refrain from using offensive language or behavior
  • Avoid being under the influence of alcohol or drugs during training
  • Maintain proper personal hygiene

Zero Tolerance Policy: We have a zero-tolerance policy for harassment, discrimination, violence, or any form of misconduct. Violation of this policy will result in immediate termination of enrollment without refund.

5. Vehicle Use and Safety

5.1 Safety Protocols

Your safety is our priority. All students must adhere to the following safety protocols:

  • Always wear seatbelts in vehicles (where applicable)
  • Wear appropriate safety gear for motorcycle training (helmet, gloves, jacket)
  • Follow all traffic rules and instructor directions
  • Report any vehicle malfunctions or safety concerns immediately
  • No use of mobile phones while operating training vehicles

5.2 Vehicle Damage

Students are responsible for any damage to training vehicles caused by:

  • Negligence or failure to follow instructions
  • Intentional misuse or abuse of vehicles
  • Operating vehicles under the influence of alcohol or drugs
  • Allowing unauthorized persons to operate training vehicles

In case of damage, the student will be liable for repair costs as determined by our assessment and professional mechanics.

5.3 Insurance Coverage

All our training vehicles are fully insured. However, the insurance does not cover:

  • Damage caused by student negligence or violation of traffic laws
  • Personal belongings left in vehicles
  • Injuries resulting from failure to use provided safety equipment

6. Certification and Testing

6.1 Course Completion

Certification is subject to successful completion of both theoretical and practical requirements:

  • Passing the internal theory test with a minimum score of 80%
  • Demonstrating competency in all practical driving skills
  • Completing the required number of training hours
  • Meeting attendance requirements

6.2 NTSA Testing

We facilitate the NTSA driving test process for our students:

  • We schedule the NTSA test on your behalf once you're ready
  • Test fees are not included in course fees and must be paid separately
  • We provide one complimentary vehicle for the first test attempt
  • Subsequent test attempts may incur additional vehicle rental fees

Note: While we strive to prepare all students for success, we cannot guarantee that you will pass the NTSA test. Your success depends on your aptitude, practice, and adherence to training.

7. Privacy and Data Protection

7.1 Information Collection

We collect and process personal information necessary for your training and certification, including:

  • Personal identification details
  • Contact information
  • Medical information relevant to driving
  • Progress and assessment records
  • Photographs for identification and certification purposes

7.2 Data Usage

Your personal information is used for:

  • Course enrollment and administration
  • Progress tracking and certification
  • Communication regarding your training
  • Compliance with NTSA and government regulations
  • Improving our services (anonymized data only)

7.3 Data Protection

We implement appropriate security measures to protect your personal information:

  • Secure storage of physical and digital records
  • Limited access to personal information
  • Regular security assessments
  • Compliance with Kenyan data protection laws

8. Liability and Limitations

8.1 Limitation of Liability

Makini Defensive Driving School shall not be liable for:

  • Injuries resulting from failure to follow safety instructions
  • Loss or damage to personal property
  • Consequences of failing NTSA tests
  • Traffic violations or accidents caused by student negligence
  • Delays or cancellations due to circumstances beyond our control

8.2 Student Responsibility

Students acknowledge and accept that:

  • Driving involves inherent risks
  • They must follow all instructions to minimize these risks
  • They are responsible for their own actions during training
  • They must disclose any medical conditions that may affect their ability to drive safely

Important: By enrolling in our courses, you acknowledge the risks associated with driving and agree to release Makini Defensive Driving School from liability for incidents not caused by our negligence.

9. Changes to Terms

9.1 Modification Rights

Makini Defensive Driving School reserves the right to modify these Terms of Service at any time. Changes will be:

  • Posted on our website
  • Displayed at our premises
  • Communicated to current students via email or SMS

9.2 Acceptance of Changes

Continued use of our services after changes have been posted constitutes acceptance of the modified terms. If you do not agree with the changes, you may:

  • Discontinue using our services
  • Request cancellation of your enrollment (subject to our refund policy)
  • Contact us to discuss your concerns

9.3 Governing Law

These Terms of Service are governed by and construed in accordance with the laws of Kenya. Any disputes shall be subject to the exclusive jurisdiction of the courts of Kenya.
